Colombia's Declaración de Renta: The Cedular System General information, not advice.

Colombia's three cedular baskets, who crosses DIAN's filing thresholds, the NIT-staggered due dates, and the foreign-asset report people miss. This guide summarizes a public tax topic in plain language and points at the sources it cites. It is general information, not tax, legal, or financial advice.

Key points

Colombia's three cedular baskets, who crosses DIAN's filing thresholds, the NIT-staggered due dates, and the foreign-asset report people miss.

Colombia taxes resident individuals on worldwide income through the declaración de renta, filed with DIAN. Residents report under a cedular system that sorts income into three separate baskets — general, pension and dividend — each computed on its own before the results are combined. Filing runs on a staggered calendar keyed to the taxpayer's NIT.

01Who has to file a declaración de renta?

Colombian tax residents whose gross income, total assets, card and other consumption, or bank deposits cross DIAN's thresholds for the year. Residence is the first half of that test. An individual is generally treated as a Colombian tax resident based on days of presence in the country across a rolling period, on family and economic ties, or on nationality combined with certain connections to Colombia. Residents are taxed on worldwide income and must report assets held abroad; non-residents are taxed only on Colombian-source income, which is often settled through withholding at source.

Residence alone does not create a filing obligation. DIAN sets thresholds — gross income, total assets, credit-card and other consumption, bank deposits — and crossing any one of them in the year brings an individual into the filing population. Those amounts are expressed in UVT (Unidad de Valor Tributario), a unit DIAN restates annually, so the peso figures move every year. Current UVT values and thresholds are published by DIAN.

02What is the cedular system?

Rather than pooling all income into one base, Colombia's cedular rules separate it into baskets and compute each independently. Since the reforms consolidated the earlier schedules, resident individuals use three:

  • General basket — employment income (salaries, wages, fringe benefits, commissions), capital income such as interest and rents, and non-employment income including commercial and professional activity.
  • Pension basket — retirement, disability and related pension income, which carries its own exemption.
  • Dividend basket — dividends and participations, with its own mechanics and credit treatment.

The point of the separation is that each basket stands alone: deductions and exempt amounts attach to the basket they belong to, and a loss arising in one basket generally cannot be set against income in another, subject to narrow exceptions. Resident individuals face a progressive marginal scale that DIAN publishes in UVT bands.

03When is the return due?

DIAN publishes a tributary calendar each year, and the due date for natural persons is staggered across roughly ten weeks by the last two digits of the NIT. Taxpayers whose NIT ends in the lowest digits file first; those ending in the highest digits file last. The staggering exists to spread load on the Muisca portal rather than to give anyone an advantage, and the assigned date is not optional.

Element How it works
Return form Form 210, for resident natural persons
Portal Muisca, DIAN's electronic filing system
Due date Assigned by the last two digits of the NIT
Tax year Calendar year
Late filing Penalty accrues per month or fraction of a month late

Late filing is penalised from the first day past the assigned date — the charge accrues by month or fraction of a month of delay, calculated against the tax charge, so a single day late is treated as a full month. DIAN publishes the current penalty rate and the minimum penalty amount.

04What do foreign residents most often miss?

Two obligations catch people out. The first is the reporting of assets held outside Colombia, which is separate from the income question: a resident can owe an informative filing on foreign holdings even where those holdings generated little or no income in the year. The second is the interaction between Colombian residence and the treaty network, which decides which country taxes a given item first and whether credit is available for tax already paid abroad.

The cedular structure itself is a third: income that would be pooled in most systems has to be sorted into the correct basket before anything else happens, and misallocation changes the result rather than merely the presentation.

05Where to get help

Individuals with a Colombian filing obligation, and anyone establishing or ending residence during a year, can compare credentialed practitioners through the recognized professional bodies for Colombia. A contador público registered in Colombia is the usual point of contact for NIT registration, Form 210 and the foreign-asset filing.

06Sources

  • DIAN (Dirección de Impuestos y Aduanas Nacionales) — Colombia's national tax and customs authority. Publishes the annual tributary calendar, the UVT value, filing thresholds, Form 210 and the Muisca portal.
  • Estatuto Tributario, articles 330 to 343 — the statutory basis for the cedular determination of income for resident natural persons.
